Welcome to Prepped Wellness! These Terms and Conditions (“Terms”) govern your access to and use of the Prepped Wellness website (“Site”), operated by Prepped Wellness LLC (“Prepped Wellness,” “we,” “us,” or “our”). By using this Site, you agree to these Terms. Please read them carefully.
1. Not Medical Advice / Assumption of Risk
The content on this Site is for informational purposes only and is not a substitute for medical advice, diagnosis, treatment, or care from a licensed healthcare professional. You use all information at your own risk.
You acknowledge and agree that you are solely responsible for decisions regarding your health and your child(ren)’s health. If you or your child experience symptoms of concern, consult a medical professional immediately. Do not discontinue prescribed medications or treatment without your provider’s direction.
2. Intellectual Property
All content on the Site—including text, graphics, logos, images, and software—is the property of Prepped Wellness and is protected by copyright and other intellectual property laws.
We grant you a non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use. You agree not to:
- Modify, reproduce, publish, distribute, or create derivative works from Site content;
- Attempt to reverse-engineer any software or functionality;
- Use the Site in any way that disrupts its operation or the experience of other users.
You do not acquire any ownership rights to Site content by using the Site.
3. Electronic Communications
By visiting the Site or communicating with us electronically, you consent to receive communications from us electronically. You agree that electronic communications satisfy any legal requirement that such communications be in writing.
4. Your Account
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account. You agree to notify Prepped Wellness immediately of any unauthorized use of your account.
Prepped Wellness is not liable for loss or damage resulting from your failure to safeguard your login information. We may suspend or terminate accounts at our discretion.
5. Must Be 18
The Site is intended for individuals aged 18 and older. If you are under 18, you may use the Site only with the involvement and permission of a parent or guardian.
6. Links to Third-Party Sites
The Site may contain links to third-party websites (“Linked Sites”). These Linked Sites are not controlled by Prepped Wellness, and we are not responsible for the content, accuracy, or updates of any Linked Site. The inclusion of a link does not imply endorsement.
7. International Users
The Site is controlled and operated in the United States. If you access the Site from outside the U.S., you are responsible for complying with local laws and regulations.
8. Indemnification
You agree to indemnify, defend, and hold harmless Prepped Wellness, its employees, officers, directors, agents, and affiliates from any claims, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of your use of the Site, violation of these Terms, or violation of any third-party rights or applicable laws.
9. Arbitration
Any dispute arising from or relating to these Terms shall be resolved through final and binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association, before a single neutral arbitrator. The arbitrator’s decision is final, and judgment may be entered in any court of competent jurisdiction.
This arbitration provision survives termination of these Terms.
10. Class Action Waiver
All claims will be handled on an individual basis. You agree that you may not participate in any class, collective, or representative action against Prepped Wellness. The arbitrator may not consolidate claims or preside over any form of class proceeding.
11. Liability Disclaimer
The Site and all information, products, and services provided through it are offered on an “as is” and “as available” basis. Prepped Wellness makes no warranties, express or implied, regarding the accuracy, reliability, or suitability of the information provided.
To the fullest extent permitted by law, Prepped Wellness is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or use, arising from or related to your use of the Site.
12. Termination / Access Restriction
We may terminate your access to the Site at any time without notice. These Terms are governed by the laws of the State of Ohio, and you consent to jurisdiction within Ohio courts for any non-arbitrated disputes.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. An enforceable provision that most closely reflects the intent of the original provision will replace the invalid provision.
14. Entire Agreement
These Terms constitute the entire agreement between you and Prepped Wellness regarding use of the Site and supersede all prior communications. A printed version of these Terms is admissible in any legal proceeding.
15. Changes to Terms
We may update these Terms at any time. The most current version will always be posted on this page. Continued use of the Site after changes constitutes acceptance of the revised Terms.
